1. Acceptance of the Terms

  • The following terms and conditions (these “Terms”) are entered into by and between you and JAAK (herein after referred to as “ Company”, “we”, “us” or “our”). These Terms govern your access to and use of our website, www.jaak.co (herein after referred to as “Site”) and your purchase of our products or services offered by us (herein after referred to as “Services”).

  • Please read the following terms and conditions carefully. By accessing, browsing or otherwise using the Services, you acknowledge that you have read and understood these Terms and accept and agreed to be bound by these Terms.

  • We reserve the right to update and revise these Terms at any time. Any such changes are effective from its date of publication and your continued use of the Services constitutes your acceptance of the revised Terms.

 

2. Order

  • This Website operates in international time and our orders will be cut off at 23:59pm (Hong Kong time). Orders placed after 23:59pm will be considered as the next working day’s order.

  • You must make payment by using a valid credit card. By entering your payment information and submitting your order, you authorise us and our third party payment processors to charge the amount of your order to your selected payment method.

    If your request for payment via your credit card is refused or delayed for process for whatever reason(s), we shall not be held liable for any delay or non-delivery of your Order.

  • Once the transaction is complete, a confirmation email will be sent to your registered email account. Please check your spam or junk email folder if you had not received the email.

    If you still had not received the email, it may mean that the payment was unsuccessful. Please check the status of your order by clicking onto the My Order section on the Website or contact us via email at: info@jaak.co (furnitures) or plant@jaak.co (plants).

  • We endeavour to assure that the contents and product descriptions on this Website are accurate, updated, and complete to the extent possible and does not warrant that any such information and content to be error-free. We have made our best efforts to enable the colours of the images of the products displayed as accurately as possible on this Website and does not warrant that the colour of the products purchased will be accurately displayed by your monitor.

  • The prices provided on this website are solely for online shopping purposes and do not include delivery charges. We may at any time and from time to time, in our sole discretion, change the contents, product descriptions, product pricing, or any fees and charges in relation to any of the Products. We may also at any time and from time to time, in our sole description, change or remove any of the pricing models in place.

  • Prices displayed on this Website are in Hong Kong Dollars. If your credit card is not denominated in Hong Kong Dollars, the final price charged in your currency will be converted at the exchange rate determined by your credit card issuing bank in accordance with the applicable exchange rate on the day your credit card issuing bank processes the transaction.

 

3. Delivery

  • We strive to make sure that our product reaches its new home as soon as possible. but as there are many factors involved in the delivery process, any times quoted for delivery are genuine estimates only and are given in good faith, but are not guaranteed. because of this, please understand that we are unable to accept any liability if there is any delay in delivery.

  • To ensure the safety of our stand and couriers, our delivery service will be suspended during red or black rainstorm warning and once the No.8 typhoon signal or above has been hoisted. If you are due for a delivery on that day, your order will be delivered the next day, at no additional charge. We do not ship to any outlying islands or other remote areas within Hong Kong. We reserve the right to refuse delivery, in our sole discretion, to locations that cannot be directly accessed by our courier service.

  • All Orders are delivered through a local courier. Standard delivery time is between 11:00 - 19:00 Monday to Friday and we will notify you an hour prior to the expected delivery time.

  • For buildings without lifts or for products that can only be accessed through staircases, there will be an additional delivery charge (also know as “stair charges”) of HKD$100 per floor. In the event that the courier is unable to access the parameters of the delivery location, a separate quotation for the delivery charge will be provided.

  • Goods are deemed to be delivered to the delivery address given and received by the recipient stated in the Order. If, for any reason, the recipient is unable to sign for the Order, you agree to and accept for additional charges in the rearrangement for delivery or to cancel your Order without refund or compensation.

  • We are not responsible for Orders returned to us by the courier due to incorrect or incomplete address or delivery information. We will also not be responsible for any damage or loss caused when Orders are left at the door or at the security/management office upon your request.

  • Our premises are not open to the public and are not offering self pick-up options at the moment.

  • Customers are free to change the contents of their orders, free of charge, for the first 24 hours upon order confirmation. An administrative fee of HKD$120 (per change) will be charged for amendments after the first 24 hours.

 

4. Return or Exchange

  • All sold items are non-refundable.

  • Once order has been submitted, Jaak will not accept any rexchanges, returns /or cancellation under any circumstances, unless Merchandise is defective.

  • All of our plants are carefully designed by botanists. However, as with all products of nature, each plant may vary in size, colour, and shape according to the season and climate. We will try our best to ensure the integrity of the plant (such as richness, colour, etc.,) and maintain an appearance that is as close to our photographs as possible. We do not accept exchanges and / or returns for any orders in the case that the product does not match the photographs on our Website. If damage is incurred during the shipment of the order, please do not sign for the order and return the plant to the courier. The courier will then contact us and we will arrange for a replacement to be delivered as soon as possible.

  • Defective Products except for plants may be exchanged (subject to stock availability) within 7 days of delivery provided that:

  • Customers must contact Jaak within 24 hours of delivery for any exchange of defective items.

  • Customer will incur all cost of returning the initially purchased products to Jaak.

  • Customers will incur all cost of the additional delivery fee of the exchanged products from Jaak to customer's desired address.

  • All tags, certificates, warranties, care instructions, product labelling, authenticity cards, dust bags and boxes are intact and returned together with the Merchandise;

  • The original invoice is presented;

  • The product does not fall within the category of “Excluded Items” as defined below;

  • The product is in Sellable Condition as defined below

  • Exchanges outside 7 days of purchase or delivery of products will not be accepted.

  • Sellable Conditon: Sellable Condition” means that the product is still in its original packaging with the original labels and price tags still attached; that the product is unused, uncleaned, unaltered and in the condition originally sold.

  • Excluded Items: No exchange will be accepted for the following items which are defined as “Excluded Items”. we cannot accept returns of sale or discounted items, one-off items, fragile items, custom ordersand any items damaged after you have acknowledged receipt are also not eligible for exchange.

  • We will arrange collection and you will be charged for the costs and expenses of returning the piece(s), which must be paid prior to the collection.

  • For any exchange of Defective items, customers must contact Jaak within 24 hours of delivery. Shipping, tax and duties on the Defective Merchandise will not be charged. Jaak reserves the right to request photographic support regarding Defective Merchandise before authorising a return.

  • In case of any dispute, we reserve the right of final decision.
